Criminal Defense

DUI Defense

Mitchell has handled nearly 100 DUI cases. What many people don't know is that under Idaho law, the criminal case is separate from the civil case between you and the Idaho Transportation Dept. regarding your license to drive. The standards of evidence are different and more importantly, the filing deadlines aren't the same. If you don't file the necessary paperwork with the ITD in time, you lose the right to request a hearing and contest your license suspension so it is important to call an attorney as soon as possible. Furthermore, since it is technically a civil case where your liberty isn't at stake, the Public Defender's Office can't help you fight to keep your license. Mitchell will handle all of the paperwork and fight for you on both fronts. He has tirelessly studied the IDAPA rules pertaining to breathalizer machines, field sobriety tests (FSTs), and all relevant case law.

I have handled a vast array of cases and gotten results at every level.  I have successfully represented numerous DUI/DUI excessive and drug charges.  In addition, I have defended major felonies including manslaughter, burglary and theft, domestic violence, aggravated battery, and sexual assault, to name a few.  I have had several clients facing life in prison or lengthy prison terms and have gotten outright dismissals prior to trial and a reduction in one such case to a simple disturbing the peace misdemeanor.  Although we are adversarial by nature, I have worked hard to maintain a professional working relationship with prosecutors giving me the ability to get favorable plea agreements for my clients.  Just because you are charged with a crime does not make you a criminal.  There are two sides to every story and my job is to stand up and be your advocate and make sure that you get treated fairly.  You are going up against two very powerful government entities and I take very seriously the privilege to represent you and ensure that your rights under the Idaho and U.S. Constitutions are being fiercely protected.

Mitchell is a native Idahoan born here in Boise. He grew up in Coeur d'Alene and was a three sport letterman at Coeur d'Alene High School. After high school, he attended Boise State University earning a Bachelor of Business Administration in Marketing in 2009. Mitchell began his law career at Valparaiso University in Indiana where after his first year, he was ranked 21 out of 180 in his class and was a member of the honors program and honors moot court team, a prestigious appellate argument team that competed against other law schools, oftentimes before sitting State or Federal appellate Judges. He then transferred to the University of Arizona James E. Rogers College of Law, a first tier, top 50 ranked law school. While there, Mitchell was a volunteer magistrate judge for the Pima County Teen Court, an alternative forum for at risk youth where young people are given a final chance to change their lives before falling into the state juvenile system. He also completed a summer federal judicial externship for the Hon. Candy W. Dale at the United States District Court for the District of Idaho.

Since graduating in 2013, Mitchell has done criminal defense work for the Boise firm Ferguson Durham, PLLC before joining Coeur d'Alene firm Amendola, Doty, & Brumley, PLLC as an associate attorney specializing in criminal defense. Mitchell has always wanted to start his own practice where he could control all aspects of the firm and be more selective in his representation of clients. When the opportunity arose to do so here in Boise, he decided to go all in.

When he is not in the office, Mitchell enjoys playing golf, traveling, spending time at the family cabin in Sun Valley, and exploring Idaho's great outdoors. His parents split time between Boise and Sun Valley and his younger sister Morgan lives in Salt Lake City. Though he grew up in north Idaho, Mitchell has always had strong ties to the Treasure Valley and Ketchum area and is excited to bring back a world class legal education to better serve its people.
